OVERVIEW
Welcome to Nozogo! In this document, "we", "us", and "our" mean Nozogo. Nozogo operates this store and website, along with all of the information, content, features, tools, products, and services associated with them, so that we can offer you, the customer, a chosen selection of products to buy (the "Services"). Nozogo runs on Shopify, the platform that allows us to provide the Services to you.
The terms and conditions that follow, together with the policies they reference (these "Terms of Service" or "Terms"), set out your rights and responsibilities when you use the Services.
Please read these Terms of Service with care. Among other things, they contain important information about your legal rights, such as disclaimers of warranties and limitations of liability.
Each time you visit, interact with, or use our Services, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not accept these Terms of Service or the Privacy Policy, you may not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT
By accepting these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and that you have given your consent for any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, whether browsing our online stores or purchasing any product or service we offer, you may be asked for certain information, such as your email address and your billing, payment, and shipping details. You represent and warrant that all information you provide in our stores is accurate, current, and complete, and that you have every right required to provide it.

We have made every reasonable effort to describe the products and services in our online stores accurately. Even so, colours and the overall appearance of a product may look different on screen depending on the device you use to view the store and how that device is set up and configured.
We do not warrant that the appearance or quality of any product or service you purchase will meet your expectations or match the way it is shown or rendered in our online stores.
We may amend product descriptions at any time, at our sole discretion and without notice. We may discontinue any product at any time, and we may limit the quantities of any product we make available to a particular person, geographic region, or jurisdiction, on a case-by-case basis.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Nozogo reserves the right, at its discretion, to accept or decline your order for any reason. An order is not accepted until Nozogo confirms its acceptance. Payment must be received and processed before we can accept an order. Please review your order carefully before submitting it, as Nozogo may not be able to honour cancellation requests after an order has been accepted. If we decline, modify, or cancel an order, we will make reasonable efforts to notify you using the email address, billing address, and/or phone number you provided when ordering.
Products may be returned or exchanged only as set out in our Refund Policy.
You represent and warrant that you are purchasing for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING
We may change prices, discounts, and promotions at any time without notice. What you pay for a product or service is the price that applied when you placed the order, as recorded in your order confirmation email. Unless we clearly state otherwise, prices shown do not include taxes, shipping, handling, customs, or import charges.
Prices in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may occasionally run promotions on the Services that affect pricing; those promotions carry their own terms and conditions, which are separate from these Terms. If there is a conflict between a promotion's terms and these Terms, the promotion's terms govern.
For every purchase you make in our stores, you agree to provide purchase, payment, and account information that is current, complete, and accurate. You agree to keep your account and other information up to date, including your email address, credit card numbers, and expiry dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you supply is true, correct, and complete, (ii) you are duly authorised to use that credit card for the purchase, (iii) charges you incur will be honoured by your credit card company, and (iv) you will pay the charges you incur at the posted prices, including shipping and handling charges and all applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY
We are not responsible for delays in shipping or delivery. Any delivery time we give is an estimate only and is not guaranteed. Delays attributable to shipping carriers, customs processing, or events outside our control are not our responsibility. Title and risk of loss pass to you at the moment we deliver the products to the carrier.

SECTION 6 - INTELLECTUAL PROPERTY
All content that forms part of our Services, including without limitation all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement of that content, belongs to Nozogo, its affiliates, or its licensors and is protected by patent, copyright, and other intellectual property laws in the U.S. and internationally.
Under these Terms you may use the Services for your personal, non-commercial use only. Unless we have given prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services. Except as expressly provided here, nothing in these Terms gives you, or should be construed as giving you, a licence or any other right under any patent, trademark, copyright, or other intellectual property of Nozogo, Shopify, or any third party. Unauthorised use of the Services may violate federal and state intellectual property laws. Any right not expressly granted in these Terms is reserved by Nozogo.
The names, logos, product and service names, designs, and slogans of Nozogo are trademarks of Nozogo or of its affiliates or licensors, and may not be used without the prior written permission of Nozogo. The name, logo, product and service names, designs, and slogans belonging to Shopify are Shopify's own trademarks. All other names, logos, product and service names, designs, and slogans appearing on the Services belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS
The Services may give you access to customer tools supplied by third parties. We do not monitor these tools, have no control over them, and have no input into them.
You acknowledge and agree that we provide access to such tools "as is" and "as available," without any warranties, representations, or conditions of any kind and without any endorsement. We have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use of optional tools offered through the site is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which the relevant third-party provider(s) supply those tools.
In future we may also offer new features through the Services (including new tools and resources). Any such new features are part of the Services and are subject to these Terms of Service as well.

SECTION 8 - THIRD-PARTY LINKS
The Services may include materials and hyperlinks to websites provided or operated by third parties (including embedded third-party functionality). We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites that you choose to visit. If you leave the Services to access such materials or third-party websites, you do so at your own risk.
We are not liable for any harm or damage related to your visit to a third-party website, or to the purchase or use of any products, services, resources, or content on a third-party website. Complaints, claims, concerns, or questions about a third party's products or services should be directed to that third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Nozogo is built on Shopify, which is the platform that allows us to provide the Services to you. Nevertheless, every sale or purchase made in our Store is made directly between you and Nozogo. By using the Services, you acknowledge and agree that Shopify bears no responsibility for any aspect of a sale between you and Nozogo, including any injury, damage, or loss caused by the products and services you purchase. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising out of or relating to your purchases and transactions with Nozogo.

SECTION 10 - PRIVACY POLICY
Personal information collected through the Services is governed by our Privacy Policy, which you can find here, and certain personal information may also be governed by Shopify's Privacy Policy, available here. By using the Services you confirm that you have read both privacy policies.
As the host of the Services, Shopify collects and processes personal information relating to your access to and use of the Services so that it can provide and improve them for you. Information you submit to the Services is transmitted to and shared with Shopify, and with third parties that may be located in countries other than your own, so that services can be provided to you. We may, but are not required to, monitor, edit, or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, or otherwise objectionable, or that infringes any party's intellectual property or these Terms of Service.
You agree that no Feedback you provide will infringe the rights of any third party, whether copyright, trademark, privacy, personality, or any other personal or proprietary right. You further agree that your Feedback will not contain libellous or otherwise unlawful, abusive, or obscene material, or any computer virus or other malware that could in any way affect the operation of the Services or of any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any Feedback. You also agree not to: (a) upload or transmit viruses or any other type of malicious code that is or may be used in any way to affect the functionality or operation of the Services; (b) copy, duplicate, reproduce, extract, sell, resell, or otherwise exploit any portion of the Services; (c) collect or track personal information belonging to other people; (d) use the Services to spam, phish, pharm, or pretext; (e) access the Services through any robot, spider, scraper, data mining or extraction tool, automatic device or process, AI tool (including agentic AI), or other automated or manual means; or (f) interfere with, bypass, or circumvent the security or authorisation features, robot exclusion headers, or other measures we use to restrict access to the Services. If we determine that you have violated any part of these Terms, we reserve the right to suspend, disable, or terminate your account at any time without notice.

SECTION 14 - TERMINATION
We may, in our sole discretion, terminate this agreement or your access to the Services (or any part of them) at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The sections on Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, and Privacy Policy continue to apply after termination, as does any other provision that by its nature ought to continue.

SECTION 15 - DISCLAIMER OF WARRANTIES
Information presented on or through the Services is made available solely for general information purposes. We do not warrant its accuracy, completeness, or usefulness. Any reliance you place on such information is strictly at your own risk. We accept no liability or responsibility for any reliance placed on those materials, whether by you, by another visitor to the Services, or by anyone who may learn of their contents.
EXCEPT AS EXPRESSLY STATED BY Nozogo, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

SECTION 16 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL Nozogo, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS OBTAINED THROUGH THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Nozogo, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or of the documents they incorporate by reference, (2) your violation of any law or of the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, although a failure to notify you promptly will not relieve you of your obligations unless you are materially prejudiced as a result. We may take control of the defence and settlement of such a claim at your expense, including selecting counsel, but we will not settle any claim that imposes non-monetary obligations on you without your consent (which will not be unreasonably withheld). You agree to cooperate in the defence of indemnified claims, including by providing relevant documents.

SECTION 18 - SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision will nonetheless be enforced to the fullest extent permitted by applicable law, and the unenforceable portion will be deemed severed from these Terms of Service. That determination does not affect the validity and enforceability of the remaining provisions.

SECTION 19 - WAIVER; ENTIRE AGREEMENT
Our not exercising or enforcing a right or provision of these Terms of Service is not a waiver of that right or provision.
These Terms of Service, and any policies or operating rules we post on this site or in respect of the Service, form the whole agreement and understanding between you and us and govern your use of the Service. They supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, without limitation, any prior versions of the Terms of Service).
Any ambiguity in the interpretation of these Terms of Service is not to be construed against the drafting party.

You may not delegate, transfer, or assign this Agreement, or your rights and obligations under these Terms, without our prior written consent, and any attempt to do so is void. SECTION 21 - GOVERNING LAW
The laws applied by the federal and state or territorial courts of the jurisdiction where Nozogo has its headquarters govern these Terms of Service and any separate agreement under which we provide Services to you, and those Terms and agreements are to be interpreted accordingly. Both you and Nozogo accept venue and personal jurisdiction in those courts.

Headings appear in this agreement solely for convenience; they do not limit or otherwise affect these Terms.

SECTION 23 - CHANGES TO TERMS OF SERVICE
The current version of the Terms of Service is available for review on this page at any time.
At our sole discretion, we may update, change, or replace any portion of these Terms of Service by posting the updates and changes on our website. Checking our website periodically for changes is your responsibility. We will notify you of any material changes to these Terms as required by applicable law, and those changes will take effect on the date stated in the notice. By continuing to use or access the Services after changes to these Terms of Service have been posted, you accept those changes.
